9. Pricing, Subscriptions, and Payments

9.1 Free Tier

Kinesa offers a free tier that includes core fitness tracking features: unlimited workout logging, up to 3 habits, daily energy check-ins, weekly summaries, and Apple Health / Google Health Connect synchronisation. The free tier is available indefinitely and does not require a payment method.

9.2 Kinesa Pro (Paid Subscription)

Kinesa Pro is an optional paid subscription that unlocks additional features, including unlimited habits, the AI Fitness Coach chat, detailed insights and analytics, and data export. Kinesa Pro is available as:

Prices are displayed in your local currency and may vary by region based on App Store or Google Play pricing. Prices may change from time to time; any price change will not affect your current billing period.

9.3 Billing and Auto-Renewal

Subscriptions are billed through Apple (App Store) or Google (Google Play), depending on your device. Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

9.4 Free Trial

We may offer a free trial period for Kinesa Pro. If offered, the trial duration will be stated at the time of sign-up. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the stated price.

9.5 Cancellation

You may cancel your subscription at any time through your device's subscription management settings (Apple Settings or Google Play). Cancellation takes effect at the end of the current billing period. You will retain access to Kinesa Pro features until the end of the period you have already paid for. No partial refunds are provided for unused portions of a billing period.

9.6 Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. Grandpoint Ltd does not process refunds directly. To request a refund, contact Apple Support or Google Play Support.

9.7 Changes to Pricing or Features

Grandpoint Ltd reserves the right to modify subscription pricing, features included in each tier, or the availability of the free tier. Material changes will be communicated through the App with reasonable advance notice.

10. Intellectual Property Rights

Kinesa and its content, including but not limited to design, code, graphics, icons, and text, are owned by GrandPoint Ltd. You receive a limited, non-exclusive, non-transferable, revocable licence for personal use only.

12. Privacy and Data Protection

Your use of Kinesa is also governed by our Privacy Policy. Please review it for details about data collection, usage, your rights, and how we protect your information.

13. Disclaimers and Limitation of Liability

Kinesa is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law:

14. Account Termination

You may delete your account at any time in Settings or by visiting our account deletion page. Upon deletion, your data is removed in accordance with our Privacy Policy.

We may suspend or terminate accounts that violate these Terms, with or without notice.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

16. Community Features (Unity)

Kinesa includes community features ("Unity") that allow you to:

We reserve the right to monitor activity feeds, remove content that violates these Terms, and suspend or terminate users. Reports can be submitted through in-app tools or by emailing support@kinesa.app. We review reports within 48 hours.

16.5 User-Generated Content

You retain ownership of content you post. By posting, you grant GrandPoint Ltd a worldwide, non-exclusive, royalty-free licence to use and display the content for the purpose of operating Unity features.

16.6 Challenge Creation

Users in good standing who are at least 18 years old may create public community challenges. Challenge creators are responsible for setting safe, achievable goals and moderating their challenges.

16.7 Disclaimers

We do not guarantee results, accuracy of data from connected devices, or real-time ranking accuracy. We are not responsible for the conduct of other users or interactions between participants.

16.8 Indemnification

You agree to indemnify and hold harmless GrandPoint Ltd from claims arising from your participation in Unity features, violations of these Terms, or content you post.

17. Notifications

Kinesa sends push notifications for reminders, achievements, and challenge updates. You can manage notification preferences in Settings or your device settings.

18. Changes to These Terms

We may update these Terms and will notify you of material changes through the App. Continued use after changes constitutes acceptance. If you disagree with changes, you should stop using the App and delete your account.

19. Dispute Resolution

Before filing a formal claim, you agree to contact support@kinesa.app to attempt to resolve the dispute informally. Disputes are governed by Section 15.
